AMEND on lines 173-176 by deleting the proposed amendments and restoring the existing language that was deleted.

FURTHER, AMEND below line 177 by inserting the following as a paragraph and renumbering the subsequent paragraph(s):

          (e)  At the discretion of the division, Medicare-certified long-term acute care hospitals may be exempted from the hospital assessment provided in this chapter if such exemption is approved by the Centers for Medicare and Medicaid Services (CMS) and does not result in the state receiving a lower federal financial participation rate for any supplemental payment program authorized by this chapter.

FURTHER, AMEND the title to conform.
