AMENDMENT NO 1 PROPOSED TO

 

Senate Bill No. 2568

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  (1)  There is hereby created the Motor Vehicle Liability Insurance Enforcement Study Committee to examine and develop recommendations regarding the most effective means of ensuring that drivers on the public roads of the state have secured motor vehicle liability insurance, including, but not limited to, the feasibility of imposing a requirement that proof of liability insurance be presented before a license tag or decal may be issued or renewed and, if feasible, the best practices for administering such a requirement.

     (2)  The study committee shall, at a minimum, study and report its findings and recommendations to the Legislature not later than October 1, 2025.  The study committee shall provide the provisions of the current Mississippi law that will need to be amended to adopt the measures described in this section and any other measures recommended by the committee.

     (3)  The committee shall be composed of the following members:

          (a)  The Mississippi Commissioner of Insurance, or his/her designee;

          (b)  The Chairman of the Senate Insurance Committee;

          (c)  The Chairman of the House Insurance Committee;

          (d)  The Chairman of the Senate Finance Committee;

          (e)  The Chairman of the House Ways and Means Committee;

          (f)  The Chairman of the Senate Appropriations Committee;

          (g)  The Chairman of the House Appropriations A Committee;

          (h)  A county tax assessor appointed by the Mississippi Assessors and Collectors Association;

          (i)  A county tax collector appointed by the Mississippi Assessors and Collectors Association;

          (j)  A member appointed at large by the Lieutenant Governor; and

          (k)  A member appointed at large by the Speaker of the House.

     (4)  At the first meeting, the study committee shall elect from among its membership a chairman, a vice chairman and any other officers determined to be necessary, and shall adopt rules for transacting business and keeping records.

     (5)  A majority of the members of the study committee shall constitute a quorum.  In the adoption of rules, resolutions and reports, and in the election of a chairman, vice chairman and any other officers determined to be necessary, an affirmative vote of a majority of the members present shall be required.

     (6)  The Mississippi Insurance Department shall provide the staff and other support necessary for the study committee to perform its duties.

(7)  To effectuate the purposes of this act, any department, division, board, bureau, committee, institution or agency of the state, or any political subdivision thereof, shall, at the request of the chairman of the study committee, provide the facilities, assistance, information and data needed to enable the study committee to carry out its duties.

     (8)  Upon the submission of its report to the Legislature, the study committee shall be dissolved.

     SECTION 2.  This act shall take effect and be in force from and after its passage.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT TO CREATE THE MOTOR VEHICLE LIABILITY INSURANCE ENFORCEMENT STUDY COMMITTEE TO EXAMINE AND DEVELOP RECOMMENDATIONS REGARDING THE MOST EFFECTIVE MEANS OF ENSURING THAT DRIVERS ON THE PUBLIC ROADS OF THE STATE HAVE SECURED MOTOR VEHICLE LIABILITY INSURANCE, INCLUDING, BUT NOT LIMITED TO, THE FEASIBILITY OF IMPOSING A REQUIREMENT THAT PROOF OF LIABILITY INSURANCE BE PRESENTED BEFORE A LICENSE TAG OR DECAL MAY BE ISSUED OR RENEWED AND, IF FEASIBLE, THE BEST PRACTICES FOR ADMINISTERING SUCH A REQUIREMENT; TO REQUIRE THE COMMITTEE TO REPORT ITS FINDINGS AND RECOMMENDATIONS TO THE LEGISLATURE BY OCTOBER 1, 2025; TO PROVIDE THE COMPOSITION OF, AND CERTAIN PROCEDURES FOR, THE COMMITTEE; TO PROVIDE THAT THE MISSISSIPPI INSURANCE DEPARTMENT SHALL PROVIDE THE STAFF AND OTHER SUPPORT NECESSARY FOR THE COMMITTEE TO PERFORM ITS DUTIES; TO PROVIDE FOR THE DISSOLUTION OF THE COMMITTEE UPON THE SUBMISSION OF ITS REPORT TO THE LEGISLATURE; AND FOR RELATED PURPOSES.
