AMENDMENT NO 2 TO AMENDMENT NO 1 PROPOSED TO

     AMEND on line 146 by striking the word "may" and inserting "shall" in lieu thereof.

     FURTHER, AMEND on line 147 by striking the words "authorized under Section 67-1-1 et seq" and inserting in lieu thereof:

follows:

              (i)  For the first violation, a civil penalty not to exceed Five Hundred Dollars ($500.00);

              (ii)  For a second violation, a civil penalty not to exceed Three Thousand Dollars ($3000.00);

              (iii)  For a third violation, revocation of ability to operate in this state and a civil penalty not to exceed Six Thousand Dollars ($6000.00);

FURTHER, AMEND on lines 362 and 363 by striking the words "Fifty Dollars ($50.00), in addition to any other penalty authorized by this article" and inserting in lieu thereof the following:

"Five Hundred Dollars ($500.00), and the department shall suspend the direct shippers permit until all outstanding taxes are paid in full, for a first offense.  Upon a second offense, the department shall revoke the direct shippers' permit"
