Senate Bill 2378

AN ACT TO CREATE SECTION 5-3-79.1, MISSISSIPPI CODE OF 1972, TO EMPOWER THE PEER COMMITTEE TO INSTITUTE A PROGRAM OF REVIEWING SELECTED ADMINISTRATIVE RULES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following shall be codified as Section 5-3-79.1, Mississippi Code of 1972:

5-3-79.1. (1) In addition to other duties and responsibilities set out in this chapter, the PEER Committee is authorized to establish a program of administrative rule reviews. Such reviews shall produce a report to the Legislature on newly adopted administrative rules and their conformity to the intent of the law authorizing them, as well as any other matter that the committee considers appropriate. Reports shall contain a recommendation for legislative action in cases where the committee believes that such is appropriate.

(2) From and after July 1, 2025, the committee may choose to select fifteen (15) rules adopted in the last year for review. Reports on these rules shall be made to the PEER Committee no later than December 15, 2025. Thereafter, the committee may review up to thirty (30) rules per year with reports being filed no later than December 15th of each year.

SECTION 2. This act shall take effect and be in force from and after July 1, 2025.
