AN ACT TO LIMIT THE AUTHORITY TO PREPARE OR SIGN A DATA COLLECTION STATEMENT, REPORT OR FORM, AS ORDERED BY AN APPRAISAL MANAGEMENT COMPANY, TO A REGISTERED TRAINEE, LICENSED APPRAISER OR CERTIFIED REAL ESTATE APPRAISER IN THIS STATE; TO PROHIBIT A PERSON WHO IS NOT A REGISTERED TRAINEE, LICENSED APPRAISER OR CERTIFIED APPRAISER FROM ASSUMING OR USING ANY TITLE, DESIGNATION OR ABBREVIATION THAT IS LIKELY TO CREATE THE IMPRESSION THAT THE INDIVIDUAL IS A REGISTERED TRAINEE, LICENSED APPRAISER OR CERTIFIED REAL PROPERTY APPRAISER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A property data collection statement, report or form relating to real estate or real property may be prepared or signed, or both, only by a person with the following active credential or registration in this state:

          (a)  A state certified real estate appraiser, as defined in Sections 73-34-3 and 73-34-19;

          (b)  A licensed real estate appraiser, as defined in Section 73-34-3;

          (c)  A trainee appraiser, as defined in Section 73-34-3, only when performing this service under the direct supervision of the certified appraiser; or

          (d)  Licensing requirements, as defined in Section 73-34-5.

     (2)  Only a person authorized under subsection (1) of this section may prepare or sign a property data collection statement, report or for or may collect, either physically, virtually or digitally, information on all types of real estate and real property in this state, including, but not limited to, commercial, industrial and residential, for the purposes of providing the collected data to a licensed or certified real estate appraiser to be used in performing valuation services or an opinion of value for the identified parcel of real estate or identified real property at any point in time.

     (3)  It is unlawful for an appraisal management company to contract or engage any individual who is not authorized under subsection (1) of this section to collect information or to prepare or sign a property data collection statement, report or form, and such individual shall not assume or use any title, designation or abbreviation that creates the impression that the individual is a registered trainee, licensed appraiser or certified appraiser.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2025.
