AN ACT TO REQUIRE PROPERTY AND CASUALTY INSURERS TO REQUIRE BLIGHTED REAL PROPERTY TO BE CLEANED UP BEFORE PAYING NOT MORE THAN NINETY PERCENT OF THE DAMAGES OWED; TO AUTHORIZE THE COUNTY OR MUNICIPALITY TO PAY THE REST; TO REQUIRE THE COMMISSIONER OF INSURANCE TO ENFORCE THE PROVISIONS OF THIS ACT AND ADOPT ANY RULES OR REGULATIONS NECESSARY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any property and casualty insurer providing coverage for blighted real property in this state must require the insured clean up the blighted real property before reimbursing the insured for not more than ninety percent (90%) of the amount of any damages owed to the insured by the insurer.  The remaining ten percent (10%) owed to the insured for any damages may be paid by the county or municipality where the blighted property is located.  The Commissioner of Insurance shall enforce the provisions of this section and shall adopt any rules or regulations necessary.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2025.
