COMMITTEE AMENDMENT NO 1 PROPOSED TO

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


SECTION 1.  The following sum, or so much of it as may be necessary, is appropriated out of any money in the Capital Expense Fund not otherwise appropriated, to the Department of Health for the purpose of funding disbursements to Mississippi hospitals, for the period beginning July 1, 2023, and ending June 30, 2024..........................

............................................... $ 38,000,000.00.

     SECTION 2.  As a condition of receiving and expending the funds appropriated to the department under this act, the department shall:

          (a)  Determine the amount of funds each hospital under the program established in Section 41-9-371 would have been eligible to receive if the funds appropriated to the program by Chapter 47, General Laws of 2023, had not been subject to any restrictions other than those imposed by Section 41-9-371;

          (b)  Determine the amount of funds each hospital actually received or will receive pursuant to a beneficiary agreement executed by April 1, 2024, under the program in Section 41-9-371;

          (c)  Determine the difference between the amount of funds in paragraphs (a) and (b) of this section; and

          (d)  Disburse the difference calculated in paragraph (c) of this section to any hospital where the difference is a positive balance.

     SECTION 3.  As a condition of receiving and expending the funds appropriated to the department under this act, the department shall not disburse funds to a hospital pursuant to Section 41-9-371 that did not have a beneficiary agreement executed by April 1, 2024.

     SECTION 4.  None of the funds appropriated by this act shall be used to pay employee premium payments.

     SECTION 5.  The money appropriated by this act shall be paid by the State Treasurer out of any money in the Capital Expense Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his or her warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 6.  This act shall take effect and be in force from and after its passage, and shall stand repealed on the day before its passage.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT MAKING AN ADDITIONAL APPROPRIATION OF CAPITAL EXPENSE FUNDS TO THE DEPARTMENT OF HEALTH FOR THE PURPOSE OF FUNDING DISBURSEMENTS TO MISSISSIPPI HOSPITALS FOR THE FISCAL YEAR 2024.
