AMENDMENT NO 2 PROPOSED TO

House Bill No.  774

     AMEND on line 186 by inserting "(1)" after "Section 5" and before the word "Gross".

AMEND FURTHER by inserting the following after line 189:

     "(2)  (a)  The gross revenue derived from any wager placed for an online sports pool and/or online racebook shall be considered gross revenue for the licensed gaming establishment located forty (40) miles or less from the location in which the wager was placed for purposes of any fee imposed and/or authorized under Section 75-76-177 and/or Section 75-76-195 and any fee authorized under the authority of a local and private law under the State of Mississippi.  If more than one (1) licensed gaming establishment is located within a forty (40) mile distance, then the revenue shall be considered gross revenue of the licensed gaming establishment that is located nearest the location in which the wager was placed.

     (b)  A platform, on behalf of the holder of a gaming license in this state, shall use the geofencing or geolocation services required by this act to determine the location in which the wager is being placed."
