Senate Bill 2083

AN ACT TO REQUIRE EMERGENCY ROOMS LOCATED ON A HOSPITAL CAMPUS AND FREESTANDING EMERGENCY ROOMS TO BE STAFFED WITH AN ON-SITE PHYSICIAN WHO IS PRIMARILY RESPONSIBLE FOR THE EMERGENCY ROOM AT ALL TIMES THAT THE EMERGENCY ROOM IS OPEN; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) An emergency room located on a hospital campus and a freestanding emergency room shall be staffed with an on-site physician who is primarily responsible for the emergency room at all times that the emergency room is open.

(2) For purposes of this act, a "freestanding emergency room" shall mean a facility open twenty-four (24) hours a day for the treatment of urgent and emergent medical conditions which is not located on a hospital campus.

SECTION 2. This act shall take effect and be in force from and after July 1, 2024.
