AN ACT TO PROHIBIT SCHOOL BOARDS FROM ADOPTING AND IMPLEMENTING CAFETERIA AND FOOD POLICY REQUIRING THE CONCEALMENT OF BRAND NAMES, LABELS AND LOGO OF COMMERCIALLY PREPARED FOOD AND BEVERAGE BROUGHT INTO THE SCHOOL CAFETERIA BY STUDENTS AS PART OF THEIR LUNCH; TO REQUIRE SCHOOL BOARD CURRENTLY ENFORCING SUCH ADOPTED POLICIES TO RESCIND THE POLICIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No school board shall adopt and implement any cafeteria or food service policy that requires students who bring any commercially prepared food or beverage product as part of their lunch to conceal the identity of such product by removing it from its original packaging or covering any identifiable brand name, label or logo.

     (2)  Any school board that has previously adopted and implemented a policy as described in subsection (1), which is currently enforced by school district employees shall rescind the policy.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2024.
