AN ACT TO REQUIRE AN ASSOCIATION OR ORGANIZATION THAT IS FUNDED, DIRECTLY OR INDIRECTLY, BY TAXPAYER FUNDS TO ALLOW ALL STUDENTS TO PARTICIPATE IN THE EXTRACURRICULAR ACTIVITIES AND EVENTS GOVERNED BY THE ENTITY ON THE SAME TERMS AND CONDITIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  An association, organization or other entity that is funded, in whole or in part, by taxpayer funds, whether appropriated directly to the association, organization or entity or through the collection of membership dues or fees paid to the association, organization or entity by a public school, agency or other governmental entity, may not prohibit participation in extracurricular activities and events under the governance of the association, organization or entity by a Mississippi student or group of students who is not enrolled in a school district or public charter school in the state.

     (2)  An association, organization or entity described under subsection (1) of this section may not impose any requirement on a nonpublic school student or group of nonpublic school students which is not imposed on all participating students and schools.  Nonpublic school students and any association or organized group of nonpublic school students may not be discriminated against in any manner.

     (3)  This section may not be construed to require a nonpublic school student to participate in any extracurricular activity or event through an association, organization or entity described under subsection (1) of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023.
