Senate Bill 3205

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF NEW ALBANY, MISSISSIPPI, TO EXPAND THE CITY'S NATURAL GAS DISTRIBUTION SYSTEM WITHIN A CERTAIN AREA OUTSIDE THE CORPORATE LIMITS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  As used in this act, "city" means the City of New Albany, Mississippi.

     (2)  The governing authorities of the city may, in their discretion, construct, expand, operate and maintain the city's natural gas distribution system for a distance of more than five (5) miles from the corporate limits in the following service area located in Tippah and Union Counties, Mississippi:

          (a)  In Tippah County:  Section 31, Township 5 South, Range 3 East; Section 32, Township 5 South, Range 3 East; Section 33, Township 5 South, Range 3 East; and

          (b)  In Union County:  Section 04, Township 6 South, Range 3 East; Section 09, Township 6 South, Range 3 East; Section 10, Township 6 South, Range 3 East.

     (3)  Whenever gas utility service is furnished to any consumer residing outside the city's corporate limits, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the city's corporate limits.

     (4)  The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a certificate of public convenience and necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provision of that law.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
