AN ACT TO PROHIBIT A DOOR-TO-DOOR FOR-PROFIT SOLICITOR FROM APPROACHING OR SOLICITING A HOME, RESIDENCE, OR SUBDIVISION, AT ANY TIME WHERE A PLACARD, SIGN OR ANY OTHER POSTING OF WHATEVER NATURE IS DISPLAYED INDICATING THAT THE HOMEOWNER OR RESIDENTIAL OCCUPANT DOES NOT WISH TO BE SOLICITED; TO PROVIDE PENALTIES FOR A VIOLATION OF THIS ACT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Any for-profit solicitor who sells, offers to sell or attempts to sell goods or services to a homeowner or resident of a home or apartment, through direct physical contact, including door-to-door solicitation, shall:
(a) Not approach or solicit a home, residence, or subdivision, at any time where a placard, sign or any other posting of whatever nature is displayed indicating that the homeowner or residential occupant does not wish to be solicited; and
(a) Comply with any applicable door-to-door solicitation ordinance consistent with state and federal law.
(2) Door-to-door for-profit solicitors shall not engage in any deceptive, misleading, unlawful or unethical business practices with customers or consumers. Such practices shall constitute improper, fraudulent or dishonest dealing.
(3) Any person convicted of a violation of this act is guilty of a misdemeanor and shall be punished by a fine of One Hundred Dollars ($100.00). In the case of continuing violations, each day shall constitute a separate charge.
SECTION 2. This act shall take effect and be in force from and after July 1, 2022.
