AN ACT TO REPEAL SECTION 97-45-17, MISSISSIPPI CODE OF 1972, WHICH PROHIBITS A PERSON FROM POSTING AN INJURIOUS MESSAGE FOR THE PURPOSE OF CAUSING INJURY TO ANOTHER THROUGH THE USE OF ANY MEDIUM OF COMMUNICATION, BECAUSE IT WAS HELD UNCONSTITUTIONAL AS A VIOLATION OF THE FREE SPEECH CLAUSE OF THE FIRST AMENDMENT TO THE UNITED STATES CONSTITUTION, IN A UNANIMOUS DECISION BY THE MISSISSIPPI COURT OF APPEALS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 97-45-17, Mississippi Code of 1972, which prohibits a person from posting an injurious message for the purpose of causing injury to another through the use of any medium of communication, is repealed.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2021.
