AN ACT TO AUTHORIZE ANY DISTRICT ATTORNEY, ON HIS OR HER OWN MOTION, TO PETITION THE COURT IN WHICH A CONVICTION OCCURRED TO REQUEST A REVIEW AND REDUCTION OF THE SENTENCE RENDERED AS A RESULT OF THE CONVICTION FOR ANY CRIME THAT IS NOT LISTED AS A CRIME OF VIOLENCE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A district attorney, on his or her own motion, may petition the court in which a conviction occurred to request a review and reduction of the sentence imposed as a result of  conviction for a crime that is not listed as a crime of violence in Section 97-3-2.  The petition shall state the reasons for such review and reduction with specificity.  Upon receipt of the petition, the judge shall review the petition and make a determination on the record as to the reduction. 

     (2)  The provisions of this section shall not be construed to limit or restrict the authority otherwise provided by law to the State Parole Board.

     (3)  The provisions of this section shall be applicable to conviction that occurred before the effective date of this act.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2021.
