AMENDMENT NO 1 PROPOSED TO

 

Senate Bill No. 2338

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  Notwithstanding any provision of law to the contrary, all residential roofing contractors operating in the State of Mississippi shall possess a license either from a municipality or county of this state, or from the State Board of Contractors.  The application for a license shall include the residential roofing contractor's Mississippi state sales tax number or, if the applicant is an individual, the contractor's social security number.

     For purposes of this section, a residential roofing contractor is a person or entity contracting or offering to contract with an owner or possessor of a residential roof system to repair or replace a roof system on residential real estate, or any portion thereof, regardless of the cost of the project, and regardless of whether all or part of the cost is expected to be paid as a benefit of a property and casualty insurance policy.

     SECTION 2.  Section 1 of this act shall be codified in Title 73, Chapter 59, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2020.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT TO REQUIRE THAT ALL RESIDENTIAL ROOFING CONTRACTORS OPERATING IN THIS STATE SHALL POSSESS A LICENSE FROM A MUNICIPALITY OR COUNTY OF THIS STATE OR FROM THE STATE BOARD OF CONTRACTORS; TO REQUIRE THAT THE APPLICATION FOR A LICENSE SHALL INCLUDE THE RESIDENTIAL ROOFING CONTRACTOR'S MISSISSIPPI STATE SALES TAX NUMBER OR, IF AN INDIVIDUAL, SOCIAL SECURITY NUMBER; TO DEFINE RESIDENTIAL ROOFING CONTRACTOR FOR PURPOSES OF THIS LICENSING REQUIREMENT; AND FOR RELATED PURPOSES.
