AN ACT TO AMEND SECTION 3-5-1, MISSISSIPPI CODE OF 1972, TO REQUIRE AFFIRMATIVE CONSENT OF THE LEGISLATURE TO AUTHORIZE THE ACQUISITION, SALE, GIFT, GRANT, OR ANY OTHER TRANSFER OF AN OWNERSHIP INTEREST IN PRIVATELY OWNED REAL PROPERTY WITHIN THE STATE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 3-5-1, Mississippi Code of 1972, is amended as follows:

     3-5-1. * * *The consent of the State of Mississippi is given, in accordance with  Pursuant to the 17th Clause, 8th Section, and of the 1st article of the Constitution of the United States, * * *to the acquisition by the United States, by purchase, condemnation or otherwise, of any land in this state which has heretofore been or may hereafter be acquired for custom houses, post offices, or other public buildings. the consent of this state may not be given to the acquisition, sale, gift, grant, or any other transfer of an ownership interest in any other privately owned real property within this state that is not in possession of any federal agency as of July 1, 2020, by the United States, which would remove the real property from state, county and municipal property tax rolls, without the express, affirmative consent of the Legislature and the Governor through the adoption and signing of a joint resolution adopted by an affirmative vote of a majority of the members the Legislature to that effect.  The joint resolution shall:

          (a)  Recite the legal description of the land;

          (b)  Recite the purposes to which the this state consents that the property may be used;

          (c)  Be adopted by an affirmative vote of a majority of the members of the Legislature; and

          (d)  Be signed by the Governor.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2020.
