AN ACT TO BE KNOWN AS KEYAURDRA'S LAW; TO CREATE NEW SECTION 97-37-39, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT ALL CENTERFIRE PISTOL AND RIFLE CARTRIDGES SOLD IN MISSISSIPPI BEAR A UNIQUE IDENTIFYING MARK; TO REQUIRE SELLERS OF AMMUNITION TO KEEP RECORDS AS TO THE PURCHASER OF SUCH AMMUNITION BY SERIAL NUMBER OR OTHER UNIQUE IDENTIFYING MARK; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 97-37-39, Mississippi Code of 1972:
97-37-39. (1) It shall be unlawful for any person to sell any centerfire pistol or rifle cartridge that does not bear on the casing thereof a serial number or other unique identifying mark.
(2) (a) It shall be unlawful for any person to sell any centerfire pistol or rifle cartridge without making a record of the serial numbers or other unique identifying mark of the cartridges sold.
(b) Records required under this section shall be retained by the seller for not less than five (5) years from the date of sale.
(3) A person who violates this section, upon conviction, shall be punished by a fine not to exceed Five Thousand Dollars ($5,000.00) or imprisonment in the custody of the Department of Corrections for a term not to exceed five (5) years, or both fine and imprisonment.
SECTION 2. This act shall take effect and be in force from and after October 1, 2020.
