House Bill 409

AN ACT TO PROVIDE THAT REMOVAL OF ANY MEMBER OF A BOARD OR COMMISSION IS INEFFECTIVE UNLESS CERTAIN REQUIREMENTS ARE MET; TO PRESCRIBE THE REMOVAL REQUIREMENTS OF MEMBERS OF A BOARD OR COMMISSION; TO REQUIRE AT LEAST 50% OF ALL OTHER MEMBERS OF THE BOARD OR COMMISSION TO VOTE IN FAVOR OF THE REMOVAL IN ORDER FOR SUCH VOTE TO BE EFFECTIVE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  (a)  Except as otherwise provided in Section 25-5-1 etc., for removal of any state, district, county or municipal officer, removal of any member of a board or commission that was created by state statute shall be ineffective unless:  (a) the person has failed to attend at least fifty percent (50%) of the regularly scheduled meetings of the board or commission within the twelve (12) month period immediately preceding the vote to remove, or the person has violated a statute of this state related to the responsibilities of his or her duties as a member of the board or commission, and (b) the majority of all other members of the board or commission vote to remove the person.

     (2)  The provisions of this section shall supersede any other provision of law to the contrary.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2020.
