AN ACT TO AMEND SECTION 63-3-1009, MISSISSIPPI CODE OF 1972, TO REQUIRE THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION TO REVIEW ALL PASSIVE GRADE RAILROAD CROSSINGS IN THE STATE EVERY THREE YEARS TO DETERMINE IF ANY CROSSINGS ARE PARTICULARLY DANGEROUS; TO REQUIRE THE DEPARTMENT TO ERECT STOP SIGNS AT CROSSINGS IT DETERMINES TO BE PARTICULARLY DANGEROUS DURING THE REVIEW; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 63-3-1009, Mississippi Code of 1972, is amended as follows:
63-3-1009. The Mississippi Transportation Commission is hereby authorized to designate particularly dangerous highway grade crossings of railroads and to erect stop signs thereat. When such stop signs are erected the driver of any vehicle shall stop within fifty (50) feet but not less than fifteen (15) feet from the nearest track of such grade crossing and shall proceed only upon exercise of due care. The Mississippi Department of Transportation shall review every passive grade crossing located within this state to determine whether the crossing should be designated a particularly dangerous highway grade crossing by January 1, 2021, and again every three (3) years thereafter. The department shall erect stop signs at any crossing it determines to be particularly dangerous during the review.
SECTION 2. This act shall take effect and be in force from and after July 1, 2020.
