AN ACT TO AMEND SECTION 37-11-23, MISSISSIPPI CODE OF 1972, TO REVISE THE PENALTY FOR DISTURBANCE OF A SCHOOL SESSION OR MEETING; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 37-11-23, Mississippi Code of 1972, is amended as follows:
37-11-23. (1) If
any person shall willfully disturb any session of * * * a school or * * * a school meeting, such
person shall be guilty of a misdemeanor and, upon conviction, shall be punished
by a fine of not less than Ten Dollars ($10.00) nor more than Fifty Dollars
($50.00).
(2) A person who, by any means, including social media, threatens to commit a crime of violence or to cause bodily injury to a superintendent, principal, teacher, student, staff or any other employee of a school, which threat is intended to terrorize, harm, intimidate, disrupt or disturb any session of the school or any school meeting, is guilty of a felony punishable by imprisonment in the custody of the Mississippi Department of Corrections for not more than five (5) years.
SECTION 2. This act shall take effect and be in force from and after July 1, 2019.
