House Bill 794

AN ACT TO PROHIBIT PUBLIC APPLICATORS FROM APPLYING CHEMICAL SPRAYS THAT CONTAIN 2,4-D, DICAMBA, MCPA AND/OR ANY OTHER HORMONE-TYPE HERBICIDE FROM APRIL 15 THROUGH OCTOBER 15; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  For the purpose of this section, the term "public applicator" means any individual who applies 2,4-D, Dicamba, MCPA and/or any other hormone-type herbicide as an employee of a state agency, municipality, county, other governmental entity or public utility.  The term "public applicator" does not include employees who work under the direct "on-the-job" supervision of a public applicator.

     (2)  A public applicator shall not apply chemical sprays that contain 2,4-D, Dicamba, MCPA and/or any other hormone-type herbicide from April 15 through October 15.

     (3)  The Commissioner of Agriculture and Commerce shall enforce the provisions of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
