AN ACT AMEND SECTION 27-103-302, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT FROM AND AFTER SEPTEMBER 1, 2018, ALL BP OIL SPILL SETTLEMENT FUNDS RECEIVED BY THE STATE SHALL BE DEPOSITED INTO THE STATE BP SETTLEMENT FUND AND THE GULF COAST RESTORATION FUND; TO CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE DESIGNATED AS THE "STATE BP SETTLEMENT FUND"; TO CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE DESIGNATED AS THE "GULF COAST RESTORATION FUND" (GCRF); TO PROVIDE THAT MONIES IN THE GCRF SHALL BE USED, UPON APPROPRIATION BY THE LEGISLATURE, TO PROVIDE ASSISTANCE TO APPLICANTS THROUGH PROGRAMS OR PROJECTS AUTHORIZED BY THIS ACT; TO PROVIDE THAT MONIES IN THE GCRF SHALL BE USED ONLY FOR PROGRAMS OR PROJECTS THAT ARE LOCATED IN THE GULF COAST REGION AS DEFINED IN THE FEDERAL RESTORE ACT; TO CREATE THE GULF COAST RESTORATION FUND ADVISORY BOARD TO PROVIDE ADVICE TO MDA WHEN REVIEWING APPLICATIONS FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT THE MISSISSIPPI DEVELOPMENT AUTHORITY (MDA) SHALL BE THE ADMINISTRATOR OF THE GCRF; TO AUTHORIZE MDA TO CARRY OUT ANY POWERS AND DUTIES AUTHORIZED IN THIS ACT AND PROVIDE THAT MDA SHALL HANDLE ALL OF THE DAY-TO-DAY MATTERS RELATING TO THE GCRF; TO LIMIT THE AMOUNT OF THE ANNUAL ADMINISTRATION EXPENSES OF MDA IN CARRYING OUT ITS DUTIES UNDER THIS ACT; TO SPECIFY THE APPLICANTS WHO ARE ELIGIBLE FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT MDA SHALL ESTABLISH CRITERIA, RULES AND PROCEDURES FOR ACCEPTING AND REVIEWING APPLICATIONS FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT MDA SHALL REVIEW, COMPILE, AND SCORE ALL TIMELY RECEIVED APPLICATIONS AND SHALL PRESENT THE APPLICATIONS AND ITS RECOMMENDATIONS FOR ASSISTANCE TO INDIVIDUAL PROJECTS TO THE LEGISLATURE NO LATER THAN DECEMBER 1 OF THE YEAR; TO PROVIDE THAT THE LEGISLATURE SHALL DETERMINE INDIVIDUAL PROJECTS THAT WILL BE FUNDED BY SEPARATE LINE ITEMS IN AN APPROPRIATION BILL; TO PROVIDE THAT APPLICATIONS FOR ASSISTANCE WILL BE RECEIVED THROUGH WEB PORTALS SET UP BY MDA; TO AUTHORIZE MDA TO ESTABLISH PROGRAMS FOR MAKING LOANS, LOAN GUARANTEES, GRANTS AND ANY OTHER FINANCIAL ASSISTANCE TO APPLICANTS WHOSE PROJECTS ARE APPROVED FOR ASSISTANCE; TO SPECIFY THE APPLICANTS WHO ARE ELIGIBLE FOR ASSISTANCE UNDER THESE PROGRAMS; TO PROVIDE THAT MDA SHALL ESTABLISH PROGRAMS AND AN APPLICATION PROCESS TO PROVIDE ASSISTANCE TO APPLICANTS WHO PRIORITIZE CERTAIN TYPES OF PROJECTS; TO PROVIDE THAT ASSISTANCE PROVIDED UNDER THIS ACT MAY NOT BE USED TO FINANCE 100% OF THE COST OF ANY PROJECT; TO PROVIDE THAT CONTRACTS EXECUTED BY MDA WITH RECIPIENTS OF ASSISTANCE UNDER THIS ACT MUST INCLUDE PROVISIONS REQUIRING A PERFORMANCE REPORT ON THE CONTRACTED ACTIVITIES; TO PROVIDE FOR FINANCIAL AUDITS OF RECIPIENTS OF ASSISTANCE UNDER THIS ACT AND PROVIDE FOR PERFORMANCE AUDITS OF MDA'S ADMINISTRATION OF THE GCRF UNDER THIS ACT; TO REQUIRE MDA TO FILE AN ANNUAL REPORT WITH CERTAIN LEGISLATIVE OFFICIALS AND LBO THAT INCLUDES DETAILED INFORMATION REGARDING RECEIPTS AND EXPENDITURES OF THE FUNDS RECEIVED AND PROVIDED AS ASSISTANCE UNDER THIS ACT; TO REQUIRE THE STATE TREASURER TO TRANSFER A CERTAIN AMOUNT OF FUNDS FROM THE BUDGET CONTINGENCY FUND TO THE 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND, MISSISSIPPI HIGHWAY-RAILROAD GRADE CROSSING SAFETY ACCOUNT AND THE MISSISSIPPI RAILROAD IMPROVEMENTS FUND; TO AMEND SECTION 9, HOUSE BILL NO. 1, FIRST EXTRAORDINARY SESSION OF 2018, TO PROVIDE THAT MONEY IN THE 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND, SHALL BE DISBURSED, IN THE DISCRETION OF THE DEPARTMENT OF FINANCE AND ADMINISTRATION, FOR CERTAIN PROJECTS; TO SPECIFY THE PROJECTS FOR WHICH MONEY MAY BE DISBURSED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 27-103-302, Mississippi Code of 1972, is amended as follows:
27-103-302. Through August 31, 2018, all funds received by or on behalf of the State of Mississippi through a negotiated settlement for economic damages in connection with the explosion on, and sinking of, the mobile offshore drilling unit Deepwater Horizon, except for any funds that are required by the settlement to be paid to any other public entity, shall be deposited into the Budget Contingency Fund for appropriation by the Legislature.
From and after September 1, 2018, all funds received by or on behalf of the State of Mississippi through a negotiated settlement for economic damages in connection with the explosion on, and sinking of, the mobile offshore drilling unit Deepwater Horizon, except for any funds that are required by the settlement to be paid to any other public entity, shall be deposited as follows: (a) twenty-five percent (25%) of each annual payment of those funds to the State of Mississippi shall be deposited into the State BP Settlement Fund created in Section 2 of this act, and (b) seventy-five percent (75%) of each annual payment of those funds to the State of Mississippi shall be deposited into the Gulf Coast Restoration Fund created in Section 3 of this act.
SECTION 2. There is created in the State Treasury a special fund to be designated as the "State BP Settlement Fund." The special fund shall consist of funds required to be deposited into the special fund by Section 27-103-302, funds appropriated or otherwise made available by the Legislature in any manner, and funds from any other source designated for deposit into the special fund. Unexpended amounts remaining in the special fund at the end of a fiscal year shall not lapse into the State General Fund but shall remain in the State BP Settlement Fund. Any investment earnings or interest earned on amounts in the special fund shall be deposited to the credit of the special fund.
SECTION 3. (1) There is created in the State Treasury a special fund to be designated as the "Gulf Coast Restoration Fund" (GCRF). The GCRF shall consist of funds required to be deposited into the GCRF by Section 27-103-302, funds appropriated or otherwise made available by the Legislature in any manner, and funds from any other source designated for deposit into the GCRF. Unexpended amounts remaining in the GCRF at the end of a fiscal year shall not lapse into the State General Fund, and any investment earnings or interest earned on amounts in the GCRF shall be deposited to the credit of the GCRF.
(2) Monies in the GCRF shall be administered by the Mississippi Development Authority (MDA), and shall be used, upon appropriation by the Legislature, to provide assistance to applicants through programs or projects authorized by this act. Monies in the GCRF shall be used only for programs or projects that are located in the Gulf Coast region as defined in the federal RESTORE Act, or twenty-five (25) miles from the northern boundaries of the three (3) coastal counties of Harrison, Hancock and Jackson, but not to expand beyond the boundaries of Hancock, Harrison, Jackson, Pearl River, Stone, and George Counties. If a county is included in the coastal zone, then the county seat and the land lying to the east, west and south within that county would be considered a part of the coastal zone.
SECTION 4. (1) Monies in the Gulf Coast Restoration Fund shall be used only for the purposes specified in this act, and no other expenditure, appropriation or transfer of monies in the GCRF shall be made except by an act of the Legislature making specific reference to the GCRF as the source of those monies.
(2) If any monies in the GCRF are obligated or pledged as security for any debt incurred by MDA, and the monies in the GCRF that have been obligated or pledged are later expended, appropriated, transferred, obligated or pledged for any other purpose, the debt for which the monies were originally obligated or pledged shall be the obligation and indebtedness of the State of Mississippi secured by the full faith and credit of the state.
SECTION 5. (1) There is created the Gulf Coast Restoration Fund Advisory Board for the purpose of providing guidance and expertise to MDA when reviewing applications for assistance under this act. The advisory board shall consist of the following seven (7) members:
(a) Three (3) appointments from the Governor;
(b) Two (2) appointments from the Lieutenant Governor; and
(c) Two (2) appointments from the Speaker of the House of Representatives.
(2) The Governor shall appoint the chairman of the board and the board shall elect such other officers as it considers necessary from among its members.
(3) A majority of the members of the board shall constitute a quorum for the conduct of meetings and all actions of the board shall be by a majority vote.
(4) The Mississippi Development Authority shall provide any necessary administrative support to the board. No person nominated for, appointed to or serving as a member of the board may be an elected official.
(5) Members of the board shall serve without compensation, per diem or mileage expense.
(6) All expenses of the MDA in carrying out its duties and responsibilities under this section shall be paid from funds in the Gulf Coast Restoration Fund.
SECTION 6. (1) MDA shall be the administrator of the Gulf Coast Restoration Fund. MDA is authorized to carry out any powers and duties authorized in this act and shall handle all of the day-to-day matters relating to the GCRF.
(2) The annual administration expenses of MDA in carrying out its duties under this act shall not exceed one percent (1%) of the amount of the funds deposited into the GCRF under Section 27-103-302 for that year. MDA may recover from applicants and recipients of funds under this act a portion of the costs associated with administering assistance provided under this act, which shall not be subject to the one percent (1%) limitation under this subsection.
SECTION 7. (1) Applicants who are eligible for assistance under this section include, but are not limited to, local units of government, nongovernmental organizations, institutions of higher learning, community colleges, ports, airports, public-private partnerships, private for-profit entities, private nonprofit entities and local economic development entities. Projects that are eligible for assistance under this section are projects that have the potential to generate increased economic activity in the region, as described in Section 8(3) of this act.
(2) MDA shall establish criteria, rules, and procedures for accepting and reviewing applications for assistance under this section. MDA, with advice from the Gulf Coast Restoration Fund Advisory Board, shall review, compile and score all timely received applications, and shall present the applications and its recommendations for assistance to individual projects under this section to the Legislature no later than December 1 of the year. The Legislature shall determine individual projects that will be funded under this section by separate line items in an appropriation bill.
(3) Applications for assistance under this section will be received through web portals set up by MDA. MDA shall set criteria for the web portal which may include protection of the confidentiality of any or all of the application.
SECTION 8. (1) MDA is further authorized, on such terms and conditions consistent with the criteria set forth in this section as it may determine, to establish programs for making loans, loan guarantees, grants and any other financial assistance from the GCRF to applicants whose projects are approved for assistance under this section. MDA shall establish criteria, rules and procedures for accepting, reviewing, granting or denying applications, and for terms and conditions of financial assistance under this section in accordance with state law. The Legislature shall appropriate monies from the GCRF to the MDA to fund the programs established under this section in an amount requested annually by MDA for such purpose.
(2) Applicants who are eligible for assistance under this section include, but are not limited to, local units of government, nongovernmental organizations, institutions of higher learning, community colleges, ports, airports, public-private partnerships, private for-profit entities, private nonprofit entities, and local economic development entities.
(3) MDA shall establish programs and an application process to provide assistance to applicants under this section that prioritize:
(a) Projects that will impact the long-term competitiveness of the region and may result in a significant positive impact on tax base, private sector job creation and private sector investment in the region;
(b) Projects that demonstrate the maximum long-term economic benefits and long-term growth potential of the region based on a financial analysis such as a cost-benefit analysis or a return-on-investment analysis;
(c) Projects that demonstrate long-term financial sustainability, including clear performance metrics, over the duration of the project;
(d) Projects that leverage or encourage leveraging of other private sector, local, state and federal funding sources with preference to projects that can demonstrate contributions from other sources than funds from the BP settlement;
(e) Projects that are supported by multiple government or private sector entities;
(f) Projects that can move quickly and efficiently to the design, engineering, and permitting phase;
(g) Projects that enhance the quality of life/place and business environment of the region, including tourism and recreational opportunities;
(h) Projects that expand the region's ability to attract high-growth industries or establish new high-growth industries in the region;
(i) Projects that leverage or further enhance key regional assets, including educational institutions, research facilities, ports, airports, rails and military bases;
(j) Projects that are transformational for the future of the region but create a wider regional impact;
(k) Projects that enhance the marketability of existing industrial properties;
(l) Projects that enhance a targeted industry cluster or create a Center of Excellence unique to the region;
(m) Infrastructure projects for business retention and development;
(n) Projects that enhance research and innovative technologies in the region; and
(o) Projects that provide outcome and return on investment measures, to be judged by clear performance metrics, over the duration of the project or program.
SECTION 9. (1) Assistance provided under this act may not be used to finance one hundred percent (100%) of the cost of any project.
(2) Contracts executed by MDA with recipients of assistance under this act must include provisions requiring a performance report on the contracted activities, must account for the proper use of funds provided under the contract, and must include provisions for recovery of assistance if the assistance was based upon fraudulent information or the recipient of the assistance is not meeting the performance requirements established by MDA of the assistance. Recipients of assistance under this act must regularly report to MDA the status of the project on a schedule determined by MDA.
SECTION 10. (1) The scope of a financial audit of recipients of assistance under this act shall include funds related to any year in which the recipient receives assistance under this act. The scope of review for these funds shall include, but is not limited to, compliance with state and federal laws related to the receipt and expenditure of those funds and the criteria established by MDA.
(2) The State Auditor shall conduct performance audits of MDA's administration of the GCRF under this act. The scope of review shall include, but is not limited to, evaluating internal controls, internal audit functions, reporting and performance requirements required for use of the assistance, and compliance with state and federal law. The audit shall include any funds disbursed under this act and matching funds provided in the contract with MDA.
(3) In addition to the rules of the State Auditor, the State Auditor shall adopt rules for the form and conduct all financial audits performed by independent certified public accountants and for audits of recipients of assistance under this act.
(4) The State Auditor may report findings to the Secretary of the Treasury of the United States in addition to the reporting requirements under state law.
(5) The costs of the audits performed as provided in this section may be paid from the GCRF.
SECTION 11. MDA shall file an annual report with the Speaker of the House, the Lieutenant Governor, the Chairs of the Appropriations Committees of the House and the Senate, and the Legislative Budget Office not later than December 1 of each year, including detailed information regarding at least the following specific areas:
(a) Receipts and expenditures of the funds received and provided as assistance under this act;
(b) Expenditures for all administration expenses of MDA in carrying out its duties under this act;
(c) Overview of applications reviewed and a detailed description of applications approved for assistance for the current year; and
(d) Schedule of all applications for which assistance was provided under this act detailing status of progress, start date, anticipated completion date, benchmark achievements, and any modifications to the original application after receipt of assistance.
SECTION 12. (1) The State Treasurer shall transfer funds from the Budget Contingency Fund to the following special funds in the following amounts:
(a) Fifty-two Million Eight Hundred Ninety-three Thousand Dollars ($52,893,000.00) to the 2018 Transportation and Infrastructure Improvements Fund created in House Bill No. 1, First Extraordinary Session of 2018;
(b) One Million Dollars ($1,000,000.00) to the Mississippi Highway-Railroad Grade Crossing Safety Account created in Section 57-43-15; and
(c) Seven Million Five Hundred Thousand Dollars ($7,500,000.00) to the Mississippi Railroad Improvements Fund created in Section 57-46-1.
(2) The State Treasurer shall transfer seventy-five percent (75%) of the amount remaining in the Budget Contingency Fund after the transfers required in subsection (1) of this section into the Gulf Coast Restoration Fund created in Section 3 of this act.
SECTION 13. Section 9, House Bill No. 1, First Extraordinary Session of 2018, is amended as follows:
Section 9. (1) A special fund, to be designated the "2018 Transportation and Infrastructure Improvements Fund," is created within the State Treasury, which shall consist of funds made available by the Legislature in any manner and funds from any other source designated for deposit into such fund. The fund shall be maintained by the State Treasurer as a separate and special fund, separate and apart from the General Fund of the state. Unexpended amounts remaining in the fund at the end of a fiscal year shall not lapse into the State General Fund, and any interest earned or investment earnings on amounts in the fund shall be deposited into such fund.
(2) Monies deposited
into the fund shall be * * * disbursed,
in the discretion of the Department of Finance and Administration, as follows:
(a) To pay the costs incurred by the Mississippi Transportation Commission and the Mississippi Department of Transportation to widen Mississippi Highway 16 to three (3) lanes as follows:
(i) From near the Neely Town Road at the DeKalb City Limits to the point at which Old Philadelphia Road ties into Mississippi Highway 16; and
(ii) Between the two (2) points at which Mississippi Highway 39 ties into Mississippi
Highway 16....................................... $2,000,000.00.
(b) To assist in paying the costs associated with preconstruction, design, engineering, land acquisition, right-of-way acquisition, construction and development of the Reunion Parkway project from Bozeman Road to Parkway East in Madison County, Mississippi................................................. $8,000,000.00.
(c) To assist the East Metropolitan Corridor Commission, which is a commission operating as a local public agency representing the Jackson Municipal Airport Authority, the City of Brandon, Mississippi, the City of Flowood, Mississippi, and the City of Pearl, Mississippi, in paying the costs associated with land acquisition and implementation of the East Metro Corridor project in Rankin County, Mississippi, from its current terminus at the southeast corner of, and within, the Jackson-Medgar Wiley Evers International Airport, traversing easterly and southerly and terminating at Interstate 20 at
Crossgates Boulevard in Brandon, Mississippi..... $8,000,000.00.
(d) To assist DeSoto County, Mississippi, in paying the costs of rebuilding Holly Springs Road in DeSoto County and drainage improvements to the road...................................... $3,000,000.00.
(e) To assist Carroll County, Mississippi, in paying the costs of repair, renovation or replacement of a closed bridge
on County Road 157 in Carroll County............. $ 500,000.00.
(f) To assist Lamar County, Mississippi, in paying the costs associated with necessary infrastructure improvements in Beat 5 of Lamar County and/or construction of recreational
facilities in Beat 5............................. $ 500,000.00.
(g) To assist Lamar County, Mississippi, in paying the costs of improvements to the intersection of Scruggs Road and Mississippi Highway 589, including, but not limited to, the relocation of portions of the road, the purchase of property related to the relocation, signage, paving, other costs related to improving the safety of the intersection and other road safety projects in Supervisors District 5 of
Lamar County..................................... $1,500,000.00.
(h) To assist Bolivar County, Mississippi, in paying the costs associated with preplanning and construction of a Mississippi River landing dock facility and related
facilities in Bolivar County..................... $1,000,000.00.
(i) To assist Rankin County, Mississippi, in paying the costs related to the extension of Gunter Road in
Rankin County.................................... $2,800,000.00.
(j) To assist the Pearl River Valley Water Supply District in paying the costs associated with the repair, rehabilitation, reconstruction or replacement of seawalls at the Ross Barnett Reservoir as required by the settlement agreement in the case of Bobby L. Baker, Jr., et al. v. Pearl River Valley Water Supply District, in the Circuit Court of Rankin County,
Mississippi, Civil Action No. 212-133E........... $4,000,000.00.
(k) To assist the City of Hattiesburg, Mississippi, in paying the costs associated with resurfacing and other improvements to Hardy Street in the City of Hattiesburg from its intersection with U.S. Highway 49 East to its intersection with
West Pine Street in the City of Hattiesburg...... $ 400,000.00.
(l) To assist the City of Hattiesburg, Mississippi, in paying the costs associated with resurfacing and other improvements to 38th Avenue in the City of
Hattiesburg...................................... $ 100,000.00.
(m) To assist Hinds County, Mississippi, in paying the costs of construction and development of the Byram-Clinton Parkway
project in Hinds County.......................... $2,000,000.00.
(n) To assist the City of Senatobia, Mississippi, in paying the costs associated with the following purposes, in the following order:
(i) Construction and development of roundabout projects and other improvements at the intersection of Main Street and Scott Street and adjoining or related intersections in the City of Senatobia;
(ii) Improvements at the intersection of Front Street and Main Street in the City of Senatobia; and
(iii) Improvements at the intersection of Heard
Street and Main Street in the City of Senatobia.. $2,300,000.00.
Any such funds that are in excess of that needed to complete the projects described in this paragraph shall be used to assist the City of Senatobia in paying the costs associated with making historically relevant infrastructure improvements in the city's downtown historic district. In addition, the scope of work for any projects described in this paragraph that are located in the city's downtown historic district must be in keeping with the character of the district.
(o) To assist in paying the costs associated with:
(i) Constructing, developing, extending and implementing wastewater infrastructure and related facilities, systems and infrastructure within and/or near Gateway Industrial Park in Pike County, Mississippi; and
(ii) Constructing access roads and related infrastructure within and/or near Gateway Industrial Park in
Pike County...................................... $3,000,000.00.
(p) To assist the City of Petal, Mississippi, in paying the costs associated with (i) the repair, rehabilitation, resurfacing, construction and reconstruction of Leeville Road/Main Street located in Forrest County, Mississippi, in the City of Petal from its intersection with the Evelyn Gandy Parkway southerly to the boundary of the corporate limits of the City of Petal; and (ii) the repair, rehabilitation, resurfacing, construction and reconstruction of Smithville Road located in
Forrest County, Mississippi, in the City of Petal $ 750,000.00.
(q) To assist the Town of West, Mississippi, in paying the costs associated with repairs, resurfacing and making other
improvements to streets in the Town of West...... $ 500,000.00.
(r) To assist Oktibbeha County, Mississippi, in paying the costs associated with the resurfacing and repaving of Longview
Road in Oktibbeha County......................... $ 750,000.00.
(s) To assist in paying the costs associated with the completion of the four-lane of Mississippi Highway 19 South at the south Philadelphia City boundary intersection at Holland Avenue and extending south along Mississippi Highway 19 South to the intersection of BIA Road 241 (also known as Tucker Road), including, but not be limited to, all necessary acquisition,
preconstruction and construction activities...... $2,000,000.00.
(t) To assist the City of Pascagoula, Mississippi, in paying the costs associated with construction and development of the East Bank Access Road project in the

(u) To assist the Pascagoula Port Authority in paying the costs associated with construction and development of the North Rail Corridor project in Jackson County,
