     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  This act shall be known and may be cited as the "Kaelin Kersh Act."

     SECTION 2.  Section 63-3-517, Mississippi Code of 1972, is amended as follows:

     63-3-517.  The speed limitations set forth in this article shall not apply to authorized emergency vehicles when responding to emergency calls and the drivers thereof sound audible signal by bell, siren, or exhaust whistle and operate blinking, rotating or oscillating lights as provided in Section 63-7-19.  This section shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the street, nor shall it protect the driver of any such vehicle from the consequence of a reckless disregard of the safety of others.

     SECTION 3.  Section 63-3-205, Mississippi Code of 1972, is amended as follows:

     63-3-205.  The provisions of this chapter applicable to the drivers of vehicles upon the highways shall apply to the drivers of all vehicles owned or operated by the United States, this state or any county, city, town, district, or any other political subdivision of the state, subject to such specific exceptions as are set forth in this chapter with respect to authorized emergency vehicles. 

     The provisions of this chapter shall not apply to persons, teams, motor vehicles and other equipment while actually engaged in work upon the surface of a highway but shall apply to such persons and vehicles when traveling to or from such work.

     No driver of any authorized emergency vehicle shall assume any special privilege under this chapter except when such vehicle is operated in response to an emergency call or in the immediate pursuit of an actual or suspected violator of the law and in compliance with Section 63-3-517.

     SECTION 4.  This act shall take effect and be in force from and after July 1, 2018, and shall stand repealed from and after June 30,2018.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT TO CREATE THE "KAELIN KERSH ACT"; TO AMEND SECTIONS 63-3-517 AND 63-3-205, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT ANY OPERATOR OF AN EMERGENCY VEHICLE AUTHORIZED TO BE MARKED WITH BLINKING, ROTATING OR OSCILLATING LIGHTS SHALL USE BLINKING, ROTATING OR OSCILLATING LIGHTS WHEN OPERATING THE EMERGENCY VEHICLE AT A SPEED IN EXCESS OF THE POSTED SPEED LIMIT; AND FOR RELATED PURPOSES.
