AN ACT TO AUTHORIZE THE SECRETARY OF STATE TO DONATE CERTAIN SUBMERGED LANDS LOCATED IN JACKSON COUNTY, MISSISSIPPI, TO THE NATIONAL PARK SERVICE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Secretary of State is hereby authorized to transfer and reconvey by means of donation to the National Park Service certain submerged lands located in Davis Bayou situated in Section 33, Township 7 South, Range 8 West, Mississippi Sound, Jackson County, State of Mississippi, and being more particularly described as follows:

Beginning at a point of intersection of lands owned by the United States of America, (National Park Service Tract Nos. 03-120 and 03-121) and the northerly margin of Davis Bayou;

Thence, with said northerly margin of Davis Bayou and the westerly boundary line of the land of the United States of America (NPS Tract No. 03-121) in a generally northwesterly direction approximately 152.00 feet to a point located on the outer edge of an existing boat dock and also the lying or being within the submerged lands of the State of Mississippi;

Thence, leaving said northerly margin of Davis Bayou and the westerly boundary line of the land of the United States of America with said submerged lands using the following traverses:

S 30° 18' 19" W 114.69 feet to a point, S 29° 05' 17" E 83.70 feet to a point, N 88° 50' 13" E 27.86 feet to a point, S 30° 49' 45" E 134.86 feet to a point, S 86° 37' 24" E 37.39 feet to a point, S 79° 38' 11" E 43.04 feet to a point, and N 46° 40' 06" E 101.81 feet to a point located along the said northerly margin of Davis Bayou and the westerly boundary line of the land of the United States of America (NPS Tract No. 03-120); Thence, with said northerly margin of Davis Bayou and the westerly boundary line of the land of the United States of America in a generally northwesterly direction approximately 195.00 feet to the point of beginning, said lands containing 1.10 acres, more or less.

     (2)  The State of Mississippi shall retain all mineral rights to the real property sold or leased under this section.

     (3)  The Secretary of State is further authorized to execute, with the approval of the Governor, any agreements, deed and other documents necessary to complete the property donation authorized under subsection (1) of this section.  The Secretary of State may correct any discrepancies in the legal description of the property provided in this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
