House Bill 1404

AN ACT TO PROHIBIT THE USE OF BUMP STOCK DEVICES; TO DEFINE BUMP STOCK DEVICE; TO PROVIDE PENALTIES FOR A VIOLATION OF THE USE OF A BUMP STOCK DEVICE; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) As used in this section, the term "bump stock device" means:

(a) Any device, designed to be attached to a semiautomatic firearm, that simulates automatic fire by allowing the firearm to discharge two (2) or more shots in a burst by activating the device; or

(b) A manual or power-driven trigger activating device constructed and designed so that when attached to a semiautomatic firearm, it increases the rate of fire of that firearm, simulating automatic fire.

(2) It shall be unlawful for a person to use a bump stock device that is attached to a semiautomatic firearm.

(3) Any person in violation of this section shall be punished:

(a) By a fine of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00), or by confinement in the custody of the Department of Corrections for not more than six (6) months, or both, in the discretion of the court, for a first conviction under this section;

(b) By a fine of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00), and confinement in the custody of the Department of Corrections for not less than thirty (30) days nor more than six (6) months, for a second conviction under this section;

(c) By confinement in the custody of the Department of Corrections for not less than one (1) year nor more than five (5) years, for a third or subsequent conviction under this section; or

(d) By confinement in the custody of the Department of Corrections for not less than one (1) year nor more than ten (10) years for any person previously convicted of any felony who is convicted under this section.

SECTION 2. This act shall take effect and be in force from and after July 1, 2018.
