AMENDMENT NO 3 TO COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1426

Amend on line 107 by inserting after the word "plaintiff" the following:  "and defendants"  [should be in bold font}

Further amend by inserting after line 157 the following:

     (*)  Within thirty (30) days of plaintiff's first disclosure pursuant to this section, each defendant, whether bankrupt or solvent, shall provide the plaintiff with invoices, purchase orders, contracts, bills of lading or other documentation evidencing any asbestos-containing product manufactured by that defendant or any other defendant that was sold, shipped or distributed to any worksite identified by plaintiff without plaintiff being required to inspect the documents at defendant's document repository or other location.

Further amend by inserting after line 211 the following:

     (*)  Documents produced by defendants under Section 11-67-7(*) are presumed to be relevant and authentic, and are admissible in evidence in an asbestos action.  A claim of privilege does not apply to any such documents.
