COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1026

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

SECTION 1.  There is hereby created in the State Treasury an emergency fund to be known as the "Mississippi National Guard State Active Duty Emergency Operations Fund" for the purpose of receiving monies enabling the Mississippi Military Department to respond to domestic events as directed by the Governor during declared states of emergency or in conjunction with approved emergency management assistance compacts.  Unexpended amounts remaining in such emergency fund at the end of a fiscal year shall not lapse into the State General Fund, and any interest earned on amounts in such emergency fund shall be deposited to the credit of the emergency fund.

SECTION 2.  No state general funds shall be deposited in the "Mississippi National Guard State Active Duty Emergency Operations Fund."

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2017.

     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

     AN ACT TO CREATE IN THE STATE TREASURY A SPECIAL FUND TO BE KNOWN AS THE "MISSISSIPPI NATIONAL GUARD STATE ACTIVE DUTY EMERGENCY OPERATIONS FUND" FOR THE PURPOSE OF MAINTAINING ANNUAL GENERAL FUND BUDGET RESTRICTIONS AND ENABLING THE MISSISSIPPI MILITARY DEPARTMENT TO RESPOND TO DOMESTIC EVENTS AS DIRECTED BY THE GOVERNOR DURING DECLARED STATES OF EMERGENCY OR IN CONJUNCTION WITH APPROVED EMERGENCY MANAGEMENT ASSISTANCE COMPACTS; AND FOR RELATED PURPOSES.
