AMENDMENT NO 1 PROPOSED TO

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  Section 37-9-13, Mississippi Code of 1972, is amended as follows:

     37-9-13.  (1)  Each school district shall have a superintendent of schools, selected in the manner provided by law.  No person shall be eligible to the office of superintendent of schools unless such person shall hold a valid administrator's license issued by the State Department of Education and shall have had not less than four (4) years of classroom or administrative experience.

     (2)  From and after January 1, 2019, in all public school districts, the local school board shall appoint the superintendent of schools of such district.  At the expiration of the term of any county superintendent of education elected at the November 2015 general election, the county superintendent of education of said county shall not be elected but shall thereafter be appointed by the local school board in the manner provided in Section 37-9-25.     (3)  However, in the event that a vacancy in the office of the county Superintendent of Education for the Webster County School District elected at the November 2015 general election shall occur before January 1, 2019, the office of Webster County Superintendent of Education shall immediately become an appointed position, and the local school board shall appoint the superintendent of the school district.

     (4)  The superintendent of schools shall have the general powers and duties to administer the schools within his district as prescribed in Section 37-9-14 et seq., Mississippi Code of 1972.

     SECTION 2.  This act shall take effect and be in force from and after its passage.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT TO AMEND SECTION 37-9-13, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR THE APPOINTMENT OF THE SUPERINTENDENT IN THE WEBSTER COUNTY SCHOOL DISTRICT IN THE EVENT A VACANCY IN OFFICE OCCURS BEFORE JANUARY 1, 2019; AND FOR RELATED PURPOSES.
