Senate Bill 2181

AN ACT TO PROHIBIT ANY STATE AGENCY OR POLITICAL SUBDIVISION OF THE STATE FROM USING ANY PERSONNEL OR FINANCIAL RESOURCES TO ENFORCE OR ADMINISTER ANY EXECUTIVE ORDER ISSUED BY THE PRESIDENT OF THE UNITED STATES THAT HAS NOT BEEN AFFIRMED BY A VOTE OF CONGRESS AND SIGNED INTO LAW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Pursuant to the sovereign authority of this state, this state and all political subdivisions of this state are prohibited from using any personnel or financial resources

to enforce, administer or cooperate with an executive order issued by the President of the United States that has not been affirmed by a vote of the Congress of the United States and signed into law as prescribed by the Constitution of the United States and which were made in pursuance thereof, this prohibition may be waived on a case-by-case basis by act of the Legislature signed by the Governor.

     (2)  Pursuant to the sovereign authority of this state, this state and all political subdivisions of this state are prohibited from using any personnel or financial resources to enforce, administer or cooperate with a policy directive issued by the United States Department of Justice to law enforcement agencies in this state that has not been affirmed by a vote of the Congress of the United States and signed into law as prescribed by the Constitution of the United States and which were made in pursuance thereof, this prohibition may be waived on a case-by-case basis by act of the Legislature signed by the Governor.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
