AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO SELL AND CONVEY ALL OR ANY PORTION OF CERTAIN STATE-OWNED REAL PROPERTY IN THE CITIES OF JACKSON, MISSISSIPPI, AND HATTIESBURG, MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Finance and Administration is authorized to sell and convey all or any portion of certain state-owned real property, and any improvements thereon, located in the City of Jackson, Hinds County, Mississippi, consisting of approximately twenty-seven and one-half (27-1/2) acres located north of the City of Byram, west of the Interstate 55 - Elton Road Interchange, the deed to which is recorded in Book 1798, Page 409 of the records in the office of the Chancery Clerk of Hinds County, at Jackson, Mississippi, and being more particularly described as follows:

Part of the West Half (W1/2) of the Northeast Quarter (NE1/4) of Section 6, Township 4 North, Range 1 East, and more particularly described as follows:

Beginning at a point on the South line of Elton Road 330 feet measured Easterly along said South line of said road from the point where the same intersects the West line of said W1/2 of NE1/4 and running thence Easterly along the South line of said road for a distance of 1,003 feet to a point where the South line of said road intersects the East line of said W1/2 of NE1/4; thence Southerly along the East line of said W1/2 of NE1/4 for a distance of 1,130 feet to a point, which said point is the Northeast corner of the Anse Moore property; thence West along the North line of the said Anse Moore property for a distance of 990 feet to a point; and

running thence Northerly in a straight line for a distance of 1,306 feet, more or less, to the point of beginning.

This is the same property conveyed to Sam Garner by E. J. Ainsworth, by deed dated December 6, 1943, and recorded in Book 374, Page 377 of the records in the Office of the Chancery Clerk of Hinds County, at Jackson, Mississippi; LESS AND EXCEPT, a parcel described as beginning at a point on the South line of Elton Road, where the same intersects the East line of the W1/2 of the NE1/4 of said Section 6, run thence North 81° 35' West a distance of 531.1 feet to the point of beginning; run thence South 9° 41' West a distance of 150 feet to a point; run thence North 81° 35' West a distance of 50 feet to a point; run thence North 9° 41' East a distance of 150 feet to a point on the South line of Elton Road; and run thence South 81° 35' East a distance of 50 feet to the point of beginning.  The excepted parcel is the same property conveyed by Mrs. Eleanor Garner to John W. Rhorer, Jr., and Doris Kate Rhorer, by deed dated December 2, 1963, and recorded in Book 1462, Page 490 in the office of the Chancery Clerk of Hinds County, at Jackson, Mississippi.

     (2)  In the event that any or all of the real property and improvements described in subsection (1) of this section is sold, the real property shall be sold for not less than the current fair market value as determined by the average of two (2) appraisals by qualified appraisers, one of whom shall be selected by the Department of Finance and Administration, and both of whom shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

     (3)  Any proceeds from the sale of the land, and any improvements thereon, listed in subsection (1) of this section, shall be deposited into the state land acquisition fund.

     (4)  The Department of Finance and Administration may correct any discrepancies in the legal description of the property provided in this section.

     (5)  The state shall retain all mineral rights in the property.

     SECTION 2.  (1)  The Department of Finance and Administration is authorized to sell and convey all or any portion of certain state-owned real property, and any improvements thereon, located in the City of Hattiesburg, Forrest County, Mississippi, consisting of approximately ten (10) acres, including a thirty thousand (30,000) square feet multi-tenant office building operated and maintained by the Department of Finance and Administration Capitol Facilities division located in the City of Hattiesburg, the deed to which is recorded in Book 751, Pages 274-278 of the records in the Office of the Chancery Clerk of Forrest County, Mississippi, and being more particularly described as follows:

A Part of the North one-half (N ½) of the Southeast Quarter (SE ¼) of Section 34, Township 4 North, Range 13 in the City of Hattiesburg, Forrest County, Mississippi, being more particularly described as commencing at the Northeast Corner of the Southeast one-quarter of said Section 34 said point being on the South Right-of-Way line of John Merl Tatum Industrial Drive, thence run N 89ᴼ 37'52" W along the North line of said Section and south Right-of-Way for 111.69 feet to and for a point of beginning, thence continue N 89ᴼ 37'52" W along said North line and South Right-of-Way for 1,200.00 feet to the intersection of the Eastern Right-of-Way line of U.S. Highway 49, thence run S 52ᴼ 12'54" W along said Eastern Right-of-way for 92.26 feet, thence run S 19ᴼ 40'00" E along said Eastern Right-of-Way for 606.22 feet, thence leaving said Right-of-Way run N 71ᴼ 01'48" E for 104.33 feet, thence run S 16ᴼ 29'33" E for 19.71 feet; thence run N 70ᴼ 50'19" E for 46.77 feet; thence run N 58ᴼ 58'04" E for 50.04 feet; thence run N 83ᴼ 18'05" E for 167.48 feet; thence run N 76ᴼ 40'37" E for 190.24 feet; thence run N 76ᴼ 42'27" E for 190.33 feet; thence run East for 340.91 feet; thence run North for 456.18 feet back to the point of beginning, said parcel containing 14.18 acres more or less.

LESS AND EXCEPT THAT PARCEL DEEDED TO THE MISSISSIPPI, DEPARTMENT OF PUBLIC SAFETY DESCRIBED AS FOLLOWS:

     A Parcel of land located in the NE ¼ of the SE ¼ Section 34, Township 4 North, Range 13 West, Forrest County, Mississippi, and being more particularly described as follows:

Commence at a concrete marker found marking the NE corner of the NE ¼ of the SE ¼ of Section 34, T 4 N, R 13 W, said point being on the southern right-of-way of the John Merl Tatum Industrial Drive; thence run North 89 degrees 52 minutes 40 seconds West along the north line of the said NE ¼ of SE ¼ and along said southern right-of-way for 111.62 feet to a crimp top pipe found, said point being the Point of Beginning; thence run South 00 degrees 14 minutes 28 seconds East for 456.18 feet to a crimp top pipe found; thence run South 89 degrees 33 minutes 01 seconds West for 341.44 feet to an iron pin found; thence run North 12 degrees 19 minutes 42 seconds West for 470.65 feet to an iron pin set on the said north line of the said NE ¼ of SE ¼, said point also being on the said southern right-of-way line of said John Merl Tatum Industrial Drive; thence run South 89 degrees 52 minutes 40 seconds East along said north line and along said southern right-of-way line for 440.00 feet back to the Point of Beginning, said parcel containing 4.11 acres, more or less.

     (2)  In the event that any or all of the real property and improvements described in subsection (1) of this section is sold, the real property shall be sold for not less than the current fair market value as determined by the average of two (2) appraisals by qualified appraisers, one of whom shall be selected by the Department of Finance and Administration, and both of whom shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2017.
