AN ACT TO PROHIBIT REGISTERED APPRAISAL MANAGEMENT COMPANIES FROM REQUIRING A CRIMINAL BACKGROUND CHECK AS A CONDITION OF EMPLOYMENT AND TO ACCEPT IN LIEU THEREOF A CONFIRMATION FROM THE MISSISSIPPI REAL ESTATE APPRAISER LICENSING AND CERTIFICATION BOARD THAT A NEW LICENSE OR RENEWAL WAS ISSUED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. A registered appraisal management company may not require a criminal background check as a condition of employment, contractual relationship, or access to an appraisal portal and shall accept in lieu thereof a confirmation from the Mississippi Real Estate Appraiser Licensing and Certification Board that a new license or the renewal of an existing license was issued after the criminal history record check required under Sections 73-34-14 and 73-34-27 was conducted. The board shall promulgate regulations, rules and forms necessary to confirm that the criminal history record check was conducted, but shall maintain the confidentiality of all information.
SECTION 2. This act shall take effect and be in force from and after July 1, 2016.
