AN ACT TO ESTABLISH A "TROOP X TROOPER SCHOOL REVOLVING FUND" TO BE ADMINISTERED BY THE MISSISSIPPI DEPARTMENT OF PUBLIC SAFETY; TO PROVIDE THAT UNUSED FUNDS APPROPRIATED TO THE MISSISSIPPI DEPARTMENT OF PUBLIC SAFETY FOR SALARIES AS A RESULT OF THE RETIREMENT, TERMINATION OR RESIGNATION OF A TROOPER PRIOR TO THE END OF THE FISCAL YEAR SHALL BE DEPOSITED ON AN ANNUAL BASIS INTO THE FUND AND EXPENDED FOR THE SUPPORT AND MAINTENANCE OF THE TROOPER SCHOOL; TO PROVIDE THAT CERTAIN FUNDS MAY BE TRANSFERRED BY THE GOVERNOR FROM THE TROOPER SCHOOL FUND IN EMERGENCY SITUATIONS INTO OTHER BUDGET CATEGORIES OF THE DEPARTMENT OF PUBLIC SAFETY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is hereby established in the State Treasury a "Troop X Trooper School Revolving Fund" to be administered by the Mississippi Department of Public Safety to provide funds for the support and maintenance of the trooper school operated by the department.  The fund shall consist of lapsed funds appropriated to the department for salaries of troopers which are available at the end of the fiscal year due to the retirement, resignation, death or termination of a trooper prior to the end of the fiscal year.  The Commissioner of Public Safety with the approval of the State Treasurer shall transfer the appropriate amount of lapsed funds under this subsection (1) to the Troop X Trooper School Revolving Fund at the end of each fiscal year, and the State Treasurer shall invest such funds in the same manner as other state funds are invested.

     (2)  At such time as the Troop X Trooper School Revolving Fund balance is sufficient, the fund shall be transferred to the proper account to defray the expense of operation of the trooper school.  Any such transfers shall be made under direction of the Commissioner of Public Safety with the approval of the State Fiscal Officer and shall only be utilized to fund the expense of operation of the trooper school.  In the event of an emergency, the Governor is authorized to transfer not exceeding 2.5% of the balance of the Troop X Trooper School Revolving Fund to be used for other budgets of the Mississippi Department of Public Safety.  Any transfers made under this subsection (2) shall be submitted to the State Fiscal Officer who shall notify the Legislative Budget Office of such action.  It is the intent of the Legislature to utilize this fund as often as necessary to train and graduate smaller classes of Mississippi Highway Safety Patrol troopers to keep the allotted number of troopers at a constant level.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2016.
