AN ACT TO CREATE THE CRIME OF EMPLOYMENT FRAUD FOR PERSONS WHO PROVIDE FALSE INFORMATION IN THE EMPLOYMENT PROCESS IN ORDER TO GAIN ACCESS TO MANUFACTURING, RETAIL, AGRICULTURAL AND OTHER BUSINESS FACILITIES; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It is unlawful for any person:

          (a)  To obtain access to a manufacturing, retail, agricultural or other business facility by false pretenses.

          (b)  To make a false statement or representation as part of an application or agreement to be employed at a manufacturing, retail, agricultural or other business facility, if the person knows the statement to be false and makes the statement with the intent to commit an act knowing that the act is not authorized by the owner of the manufacturing, retail, agricultural or other business facility.

     (2)  (a)  For a first offense, a person convicted of violating this section is guilty of misdemeanor and shall be punished by a fine not to exceed One Thousand Dollars ($1,000.00) or imprisonment for a term not to exceed one (1) year, or both.

          (b)  For a second or subsequent offense, a person convicted of violating this section is guilty of a felony and shall be punished by a fine not to exceed Five Thousand Dollars ($5,000.00) or imprisonment for a term not to exceed five (5) years, or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2015.
