AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF TISHOMINGO COUNTY, MISSISSIPPI, TO PROVIDE FOR THE ELECTION OF THE BOARD OF COMMISSIONERS OF THE TISHOMINGO COUNTY WATER DISTRICT, INC., RATHER THAN THE APPOINTMENT OF SUCH COMMISSIONERS BY THE BOARD OF SUPERVISORS; TO PROVIDE WHEN THE INITIAL ELECTION IS TO BE HELD AND WHEN SUCH COMMISSIONERS ARE TO TAKE OFFICE AFTER THEIR ELECTION; TO PROVIDE THAT ANY MEASURES THAT ARE PASSED AND BUSINESS THAT IS CONDUCTED BY SUCH COMMISSIONERS SHALL REQUIRE A MAJORITY VOTE OF THE COMMISSIONERS RATHER THAN A UNANIMOUS VOTE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  (a)  Notwithstanding the provisions of Section 19-5-151, et seq., Mississippi Code of 1972, the Board of Supervisors of Tishomingo County, after adopting a resolution, shall provide for the election of a Board of Commissioners of the Tishomingo County Water District, Inc.  The commissioners of the water district shall be elected to serve a four-year term by the members of the district by a vote from meter holders located in such water district. 

          (b)  The initial election, provided for in Section (1) (a) of this section, shall be held on the second Tuesday in November of 2015, and on the second Tuesday of each November each four years thereafter.  The commissioners shall be elected at large with the five (5) individuals receiving the highest number of votes being elected to serve as commissioners. 

          (c)  After the initial election is held on the second Tuesday in November of 2015, as prescribed under this section, the five (5) persons receiving the highest number of votes shall take office on the first Tuesday in January of 2016, and on each four-year term thereafter following their election to office.  Any vacancies shall be filled by the procedure set forth in Section 23-15-839, Mississippi Code of 1972.

     (2)  Any business that is conducted and measures that are passed by the commissioners shall require a simple majority when a quorum is present. 

     SECTION 2.  This act shall take effect and be in force from and after its passage.
