AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION AND THE MISSISSIPPI HIGHWAY SAFETY PATROL TO ENTER INTO A MEMORANDUM OF UNDERSTANDING FOR THE PURPOSE OF PROVIDING RESOURCES TO ESCORT SUPER OVER DIMENSIONAL LOADS ON HIGHWAYS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Mississippi Department of Transportation and the Mississippi Department of Public Safety's Division of the Mississippi Highway Safety Patrol may enter into a memorandum of understanding for the purpose of creating rules and regulations that allow the agencies to provide resources for the purpose of escorting super over dimensional loads on Mississippi state highways and federal interstates.  The agencies may assign personnel and equipment on an overtime or extra time basis with the costs of the escorts being reimbursed to the agency by the owner or transporter of the super over dimensional load.  Nothing in this act shall be construed to prevent an owner or transporter from using a local law enforcement agency.

     Super over dimensional loads shall be defined in the Mississippi Department of Transportation's rules and regulations and shall not be amended or altered by way of the memorandum of understanding between these agencies.  Nothing in this act shall be construed to require a memorandum of understanding between the agencies.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
