AN ACT TO AUTHORIZE THE DEPARTMENT OF REVENUE TO DEVELOP A SYSTEM, INCLUDING THE USE OF AN AUCTION OR SIMILAR PROCEDURE, FOR THE MARKETING AND SALE OF CERTAIN PERSONALIZED AND DISTINCTIVE LICENSE TAGS; TO AUTHORIZE THE DEPARTMENT TO ENTER INTO A CONTRACT WITH A VENDOR OR OTHER ENTITY FOR THE PURPOSE OF ASSISTING IN DEVELOPING AND OPERATING SUCH A SYSTEM; TO PROVIDE THAT IF THE DEPARTMENT OF REVENUE DEVELOPS SUCH A SYSTEM, THE SYSTEM SHALL BE USED FOR THE MARKETING AND SALE OF LICENSE TAGS FOR THE LICENSE PLATE OR TAG SERIES BEGINNING ON OCTOBER 1, 2018; AND FOR RELATED PURPOSES. 

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Revenue may develop a system, including the use of an auction or similar procedure, for the marketing and sale of license tags issued under Sections 27-19-48, 27-19-56.4, 27-19-56.7, 27-19-56.8 and 27-19-56.15.  The department may enter into a contract with a vendor or other entity for the purpose of assisting the department in developing and operating such a system.  If the Department of Revenue establishes such a system, the department shall use the system for the marketing and sale of license tags for the license plate or tag series beginning on October 1, 2018.

     (2)  The Department of Revenue shall file a report with the Secretary of the Senate and the Clerk of the House of Representatives before December 1, 2016, describing the status of the development of the system described in subsection (1) of this section. 

     (3)  The Department of Revenue shall have all powers necessary to develop, implement and administer the system described in this section, and the department shall promulgate rules and regulations, in accordance with the Mississippi Administrative Procedures Law, necessary for the implementation of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2015.
