AN ACT TO AUTHORIZE ANY SIGNED INSURANCE DOCUMENTS MAINTAINED BY INSURANCE AGENTS TO BE DISPOSED OF AFTER THREE YEARS FROM THE CANCELLATION OR EXPIRATION OF THE POLICY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Beginning with documents signed on or after July 1, 2015, any signed insurance document maintained in the office of an insurance agent in the State of Mississippi may be disposed of after three (3) years from the cancellation or expiration of the policy.
(2) A document subject to the requirements of subsection (1) of this section whose retention period expires during any litigation, claim, negotiation, audit, public information request, administrative review, or other action involving the document may not be destroyed until the completion of the action and the resolution of all issues that arise from it.
SECTION 2. This act shall take effect and be in force from and after July 1, 2015.
