House Bill 211

AN ACT TO REQUIRE ANY SIGNED INSURANCE POLICY, CERTIFICATE, PLAN OR PROGRAM DOCUMENTS TO BE RETAINED BY THE INSURER OR INSURANCE AGENT FOR A PERIOD OF NOT LESS THAN THREE YEARS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Beginning with documents signed on or after July 1, 2015, any signed insurance policy, certificate, plan or program document must be retained by the insurer or insurance agent for a period of not less than three (3) years from the date the document was last signed.

     (2)  A document subject to the requirements of subsection (1) of this section whose retention period expires during any litigation, claim, negotiation, audit, public information request, administrative review, or other action involving the document may not be destroyed until the completion of the action and the resolution of all issues that arise from it.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2015.
