AN ACT TO CREATE NEW SECTION 63-3-1217, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE OPERATION OF OFF-ROAD VEHICLES ON THE PUBLIC STREETS, ROADS, HIGHWAYS AND ALLEYS OF THIS STATE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 63-3-1217, Mississippi Code of 1972:

     63-3-1217.  (1)  No off-road vehicle, as defined by Section 63-31-3, may be operated on any public road, alley, street or highway unless the off-road vehicle:

          (a)  Qualifies as an implement of husbandry as defined in Section 63-21-5 or:

          (b)  All of the following are true for the off-road vehicle;

               (i)  The motor vehicle privilege tax has been paid and a motor vehicle license tag has been issued to the vehicle as required by Title 27, Chapter 9, Mississippi Code of 1972; and

               (ii)  A motor vehicle inspection sticker has been issued to the vehicle as required by Title 63, Chapter 13, Mississippi code of 1972; and

               (iii)  The vehicle is equipped with all the equipment, in proper working order, required by Title 63, Chapter 7, Mississippi Code of 1972; and

               (iv)  The vehicle is covered by a policy of automobile liability insurance or other proof of personal responsibility as required by Title 63, Chapter 15, Mississippi Code of 1972.

     (2)  Violation of this section shall be punished as follows:

          (a)  For a first offense, by a fine not to exceed Twenty-five Dollars ($25.00);

          (b)  For a second offense, by a fine not to exceed One Hundred Dollars ($100.00); and

          (c)  For a third or subsequent offense, by a fine not to exceed Two Hundred Fifty Dollars ($250.00).

     SECTION 2.  This act shall take effect and be in force from and after its passage.
