House Bill 827

AN ACT TO AMEND SECTION 37-151-6, Mississippi Code of 1972, TO REVISE THE REQUIREMENT THAT THE MISSISSIPPI ADEQUATE EDUCATION PROGRAM BE FULLY FUNDED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 37-151-6, Mississippi Code of 1972, is amended as follows:

     37-151-6.  * * *Effective with fiscal year 2007, It is the intent of the Legislature that the Mississippi Adequate Education Program be fully funded; however, the actual determination as to whether or not sufficient state revenues are available in any given fiscal year to fully fund the program must be made on annual basis with due consideration given to all needs of the state and the total funds available to meet those needs in the fiscal year for which funds are being appropriated.  To that end, the Legislature shall * * *fully fund the Mississippi Adequate Education Program as funds are available.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
