AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE DEPARTMENT OF WILDLIFE, FISHERIES AND PARKS, IS AUTHORIZED TO SELL AND CONVEY A CERTAIN PARCEL OF STATE-OWNED PROPERTY LOCATED IN CLAIBORNE COUNTY, MISSISSIPPI, AND BEING A PART OF THE CANEMOUNT WILDLIFE MANAGEMENT AREA; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Department of Finance and Administration, acting on behalf of the Department of Wildlife, Fisheries and Parks, is authorized to sell and convey a certain parcel of state-owned property located in Claiborne County, Mississippi, and being a part of the Canemount Wildlife Management Area, and containing the historic home and outbuildings, provided that the sale and conveyance is subject to the requirements of Section 29-1-1 and such other conditions authorized in this section. The property is more particularly described as follows:
Point of Commencement (POC) being the SE corner of irregularly shaped section 48, Township 11 North, Range 1 East, located at MS West NAD 83 FT coordinates 869193.392, 2052684.338; from(POC) travel N 79º 43’ 13” W for 3107.634 feet to a point; thence N 14º 23’ 37” E for 1117.215 feet to the Point of Beginning (POB); thence N 0º 56’ 45” W for 788.031 feet to a point; thence along a curve following MS 552 to the right with a chord bearing and distance of N 8º 4’ 49” E, for 688.916 feet, said curve radius being 2200 feet, to a point; thence S 90º E for 1106.426 feet to a point; thence S 0º E for 1470 feet to a point; thence S 90º W for 1190.263 feet to the POB.
(2) The real property and the improvements thereon, described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the average of at least two (2) appraisals by qualified appraisers, one (1) of which shall be selected by the Department of Finance and Administration, and both of whom shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.
(3) All monies derived from the sale of the property described in subsection (1) of this section shall be deposited into a special fund created in the State Treasury for the use and benefit of the Department of Wildlife, Fisheries and Parks. Unexpended amounts remaining in the special fund at the end of the fiscal year shall not lapse into the State General Fund, and any interest earned on the amounts in the special fund shall be deposited to the credit of the special fund.
(4) The Department of Finance and Administration may correct any discrepancies in the legal description provided in this section.
(5) The State of Mississippi shall retain all mineral rights to the property sold under this section.
SECTION 2. Any advertisements or notices required to effect the sale of the property described in Section 1 of this act shall include information stating that the house located on the property is listed on the National Register of Historic Landmarks, and remains subject to any and all applicable rules and regulations appertaining thereto subsequent to any purchase thereof.
SECTION 3. This act shall take effect and be in force from and after July 1, 2014.
