AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF DREW IN SUNFLOWER COUNTY, MISSISSIPPI, TO EXPAND ITS WATER DISTRIBUTION SYSTEM WITHIN CERTAIN AREAS THAT ARE MORE THAN FIVE MILES OUTSIDE THE CORPORATE LIMITS OF THE CITY OF DREW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the City of Drew in Sunflower County, Mississippi, may, in their discretion, construct, expand, operate and maintain the water distribution system of the City of Drew in the following area that is more than five (5) miles from the corporate limits of the City of Drew:

Beginning at the Southwest corner of Section 12, Township 23 North, Range 3 West, Sunflower County, Mississippi, Run thence North for 3.0 miles, thence West for 1.5 miles, thence North for 1.0 Mile, thence East for 2.5 miles to the Sunflower County Line, thence South for 4.0 miles along the county line, thence West for approximately 1.0 mile to the Point of Beginning.  The above described tract being situated in Sections 12 and 1, Township 23 North, Range 3 West; Sections 25, 26, 27, 36, Township 24 North, Range 3 West, Sunflower County, Mississippi.

     (2)  Whenever such water utility service is furnished to any consumer residing outside the corporate limits of the City of Drew, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the corporate limits of the City of Drew.

     (3)  The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provisions of that law.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
