AN ACT TO CREATE THE PARENTAL RIGHTS ACT; TO PROTECT A PARENT'S RIGHT TO DIRECT THE UPBRINGING OF THE PARENT'S CHILD; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Parental rights protected.  (1)  The liberty of a parent to direct the upbringing, education, and care of his or her child is a fundamental right.

     (2)  The State of Mississippi or any agency thereof shall not infringe this right without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwise served.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
