AN ACT TO PROHIBIT ANY PERSON WHO IS NOT A MOTOR VEHICLE DEALER LICENSED OR PERMITTED IN THE STATE OF MISSISSIPPI FROM SELLING ANY MOTOR VEHICLE UNLESS THE SELLER SHALL HAVE IN HIS POSSESSION THE TITLE AND REGISTRATION FOR THAT VEHICLE, WHICH MUST BE TITLED AND REGISTERED IN THE NAME OF THE SELLER; TO PROVIDE THAT A VIOLATION OF THIS PROVISION IS A MISDEMEANOR; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  It shall be unlawful for any person who is not a motor vehicle dealer licensed or permitted in the State of Mississippi to sell any motor vehicle unless the seller shall have in his possession the title and registration for that vehicle, which must be titled and registered in the name of the seller, unless the person is selling the motor vehicle to a licensed used motor vehicle parts dealer or scrap metal processor in compliance with Section 63-21-39.  Any person who violates this section shall be guilty of a misdemeanor and, upon conviction, shall be fined not less than One Thousand Dollars ($1,000.00) or more than Five Thousand Dollars ($5,000.00) per violation.  All local and state law enforcement agencies shall have jurisdiction to enforce this law.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
