AN ACT TO CREATE NEW SECTION 77-3-18, MISSISSIPPI CODE OF 1972, TO ALLOW, UNDER PRESCRIBED CONDITIONS, THE PROVISION OF ELECTRICITY TO VEHICLES IN CERTIFICATED ELECTRIC SERVICE AREAS IN THE STATE OF MISSISSIPPI BY PERSONS OTHER THAN THE CERTIFICATED ELECTRIC PUBLIC UTILITY FOR THE PURPOSE OF PROVIDING AN ELECTRICAL CHARGE TO THE VEHICLES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 77-3-18, Mississippi Code of 1972:
77-3-18. Nothing in this article shall prohibit any person, referred to herein as a "vehicle-charge provider," from providing within any certificated electric utility service area, for compensation on a metered or consumption basis or otherwise, electricity to vehicles for the purpose of providing an electrical charge to the vehicles, provided that the vehicle-charge provider shall provide no electricity to any person or entity for any purpose other than to provide an electrical charge to any such vehicles and that safe conditions shall be maintained by the vehicle-charge provider in accordance with the applicable safety codes, rules and regulations. In addition, the vehicle-charge provider shall be exclusively responsible for safe operation, and the certificated electric public utility serving the area shall continue to be the exclusive provider of electricity to and for the public for compensation to all electrical load within the certificated area, including the load of the vehicle-charge provider.
SECTION 2. This act shall take effect and be in force from and after July 1, 2013.
