AN ACT TO PROHIBIT A SELLER IN THE SALE OF GOODS OR SERVICES FROM IMPOSING A SURCHARGE ON A BUYER WHO USES A CREDIT CARD FOR AN EXTENSION OF CREDIT INSTEAD OF CASH, A CHECK, OR A SIMILAR MEANS OF PAYMENT; TO PROVIDE FOR A PENALTY FOR VIOLATIONS OF THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  In the sale of goods or services, a seller may not impose a surcharge on a buyer who uses a credit card for an extension of credit instead of cash, a check, or a similar means of payment.  As used in this section, the term "credit card" has the meaning as defined in Section 97-19-9.

     (2)  A person who violates this section is guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than Five Hundred Dollars ($500.00), or by imprisonment in the county jail for not more than six (6) months, or by both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
