House Bill 512

AN ACT TO PROVIDE A METHOD FOR A CONTRACTOR WHOSE SERVICES HAVE BEEN TERMINATED TO RECEIVE PAYMENT FOR SERVICES RENDERED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Notwithstanding any other provision of law to the contrary, any contractor whose services have been terminated on a construction or renovation project shall be authorized to take the following steps in order to receive payment for services rendered and the party that contracted with the contractor shall be bound by the results:

          (a)  The contractor must obtain the services of an impartial expert to inspect the work performed;

          (b)  The expert must provide his findings to both parties; and

          (c)  Upon presentation the contractor shall be paid for services rendered without the necessity of filing a complaint in court.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
