AN ACT TO AUTHORIZE THE CITY OF OLIVE BRANCH, MISSISSIPPI, TO ASSIST THE BOARD OF SUPERVISORS OF DESOTO COUNTY, MISSISSIPPI, THE STATE OF TENNESSEE AND OTHER GOVERNMENTAL ENTITIES LOCATED IN TENNESSEE, TO IMPROVE STATELINE ROAD AND REMOVE ALL SAFETY HAZARDS THAT AFFECT STATELINE ROAD; TO AUTHORIZE THE CITY OF OLIVE BRANCH TO TAKE CERTAIN ACTIONS WITH REGARD TO STATELINE ROAD; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The governing authorities of the City of Olive Branch, Mississippi, are authorized and empowered, in their discretion, to take any action that they consider necessary to assist the Board of Supervisors of Desoto County, Mississippi, the State of Tennessee and other governmental entities located in Tennessee, to improve Stateline Road and remove safety hazards that affect Stateline Road.
(2) The governing authorities of the City of Olive Branch, Mississippi, are authorized and empowered, in their discretion, to:
(a) Resurface or realign Stateline Road including the parts of the road that are located in Tennessee;
(b) Do any work it considers necessary within the right-of-way of Stateline Road including the parts of the right-of-way that are located in Tennessee;
(c) Remove any safety hazard or contribute funds for the removal of any safety hazard on the right-of-way of Stateline Road that is located in Tennessee, or that is located in Tennessee adjacent to the right-of-way of Stateline Road if:
(i) The governing authorities deem the condition to be dangerous;
(ii) The State of Tennessee, Shelby County, Tennessee, or Memphis, Tennessee, agree in writing to allow Olive Branch to remove the safety hazard or contribute funds for the removal of the safety hazard; and
(iii) All affected landowners acquiesce to the work and give the appropriate Tennessee governmental entity the authority and grant all necessary easements;
(d) Compensate Tennessee landowners for necessary easements and pay for any damages to a Tennessee landowner's property; and
(e) Enter into agreements with Tennessee landowners that encompass the scope of the work to be done by Olive Branch and any necessary repairs for any damage to the landowner's property.
(3) The governing authorities of Olive Branch, Mississippi, are authorized and empowered, in their discretion, to make the most efficient use of their powers and resources by cooperating and contracting with the State of Tennessee, Shelby County, Tennessee, or Memphis, Tennessee, on a basis of mutual advantage, to undertake construction projects and share costs associated with road work on Stateline Road, including parts of the road located within Tennessee. Pursuant to this authority, the City of Olive Branch may contribute funds toward a Stateline Road construction or maintenance project awarded by a Tennessee governmental entity in accordance with applicable Tennessee public purchasing laws.
SECTION 2. This act shall take effect and be in force from and after its passage.
