AN ACT TO AUTHORIZE ANY CITY, COUNTY OR STATE CORRECTIONAL FACILITY TO INFORM ANY PREGNANT INMATE ABOUT RECEIVING A TUBAL LIGATION OR A SIMILAR MEDICAL PROCEDURE IMMEDIATELY AFTER THE INMATE GIVES BIRTH; TO PROVIDE THAT SUCH TUBAL LIGATION OR MEDICAL PROCEDURE MAY NOT BE PERFORMED UNLESS THE INMATE GIVES WRITTEN VOLUNTARY INFORMED CONSENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Any city, county or state correctional facility is authorized to inform any pregnant inmate about receiving a tubal ligation or a similar medical procedure immediately after the inmate gives birth if such inmate will give birth while incarcerated in such facility.

     (2)  After a correctional facility informs a pregnant inmate, as prescribed in this section, then medical personnel is authorized to perform such tubal ligation or similar medical procedure for the inmate if written voluntary informed consent is given by the inmate.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2012.
